A recent case in the Court of Appeal related to whether a child should have contact with the non-residing parent. In Re C (Direct Contact: Suspension) [2011] EWCA Civ 521 it confirmed the initial decision to suspend contact was correct. The court confirmed that it was in the child’s best interests to withhold contact to try to ensure that contact would work in the long run. Once again, the case demonstrates the courts’ determination to prioritise the child’s needs over the parent’s.

Personal Injury News

A West Browmwich pensioner has received £25,000 in damages as a result of injuries received after a bus driver pulled away suddenly as she was getting off at her stop. As a result of the accident the pensioner suffered neurological and mobility problems. The settlement was agreed out of court. The case reaffirms that bus companies have a general duty to ensure that drivers do not drive in a way that puts passengers at risk.

Employment News – Redundancy Scoring

The Employment Appeals Tribunal has confirmed in the case of Dabson v David Cover & Sons Limited that it is not appropriate for an Employment Tribunal to scrutinise marking in redundancy selections in the absence of obvious mistake or absence of good faith. This adds some clarity to the general position that redundancy scoring exercises are not going to be investigated by Employment Tribunals unless there are exceptional circumstances such as bias or obvious mistake. If an employer acts fairly and reasonably in carrying out any redundancy scoring exercises any faults in strict procedure may be overlooked. That ‘may’ should be approached with caution however – a sensible employer will take steps to ensure that the test is carried out as fairly as possible.
