Preparation of Compromise Agreements

Employers will often be faced with situations where one employee or more needs to be made redundant. It is usually sensible to obtain the employee’s agreement to any settlement proposals. To this end employees will generally need to sign a ‘Compromise Agreement’ which acknowledges receipt of the compensation on the basis that their rights to pursue claims arising out of their employment (particularly unfair dismissal) are waived. These days there are many claims which an employee can bring and it is vital for an employer to obtain a final settlement when making an employee redundant so there can be no ‘comeback’. James Pearce & Co can advise on the appropriate level of payment that should be made and can draw up the agreement to suit the individual circumstances. These documents are very technical and specialist advice is needed.

Advising on a Compromise Agreements for Employees

If you have been given or are about to be given a Compromise Agreement we can advise you on the wisdom of the redundancy proposals themselves, particularly the compensation proposed. We can attempt in some circumstances to negotiate an increase with your employer. We can sign off the Compromise Agreement itself (only an external qualified solicitor or other suitably qualified person is legally required to sign the Agreement under the Equality Act 2010) and can deal with all post-signature formalities with your employers.

Costs

We offer a fixed fee charge for preparing Compromise Agreements for employers. If you are an employee and have received or are about to receive a Compromise Agreement normally the cost of the advice upon the Agreement is met by your employer and therefore you do not have to pay any costs to us. If the advice is particularly involved we may make a charge. We will discuss any cost aspect with you in full before undertaking any work.
