James Pearce & Co residence solicitors advise and assist upon all aspects of residence disputes. These are sometimes known as ‘custody’ disputes. When parties separate and children are involved then the issue of which party the children live with can arise. Any such disputes are, by their very nature, sensitive matters and require careful handling by experienced advisors. We have a dedicated team who deal with these sorts of cases. Our specialist legal team assists with all aspects of residency claims. Sometimes such claims are strongly contested; we can represent you to obtain the best and most appropriate order.

Residence Orders

You may have received an application for residence by your ex-spouse or partner (sometimes known as a ‘section 8’ application) and we can advise you upon all aspects of such an application. You may wish to bring an application yourself. In either case we are here to guide you through the complicated procedure involved. If court representation is required then we have specialist advocates who will attend court on your behalf.

Cost

We appreciate that residence advice has a cost. In some circumstances we may be able to provide our services to you through the Community Legal Service (formerly known as ‘legal aid’). Such provision will be dependant upon your financial position. Please ask any of our advisors about this service if you feel it may apply to you but we will, in any event, advise you as to whether or not you are entitled to this assistance. Otherwise, if you have to pay privately for our services we will be clear and transparent from the outset as to what our charges will be. We will give fixed estimates as to any work that will be carried out but that is not always applicable where matters are ‘open-ended’ and are not capable of fixed estimates. In such cases, we shall give you full details of our charging rates and our costs generally. Please ask though if there is any aspect of our rates that you do not understand – we’re happy to help.
