James Pearce & Co separation solicitors advise and assist upon all aspects of separation matters. Not all family breakdowns result in actual divorce. In such circumstances, there usually still remain financial matters to be resolved between the parties not least involving the future ownership of any property owned by them. There may also be issues involving the children as well as financial and maintenance aspects. If need be, the assistance of the court can be sought to obtain formal orders in respect of the ownership of the property and where children are to live and the rights of a parent to see their children.

Judicial Separation

The court can issue a decree of judicial separation which involves obtaining a formal order from court permitting the parties to live separate and apart. Financial orders can be obtained in all cases when a decree of judicial separation is obtained. We can advise and assist in respect of judicial separation petitions received by you or if you wish to commence such proceedings.

Cost

We appreciate that separation advice has a cost. In some circumstances we may be able to provide our services to you through the Community Legal Service (formerly known as ‘legal aid’). Such provision will be dependant upon your financial position. Please ask any of our advisors about this service if you feel it may apply to you but we will, in any event, advise you as to whether or not you are entitled to this assistance. Otherwise, if you have to pay privately for our services we will be clear and transparent from the outset as to what our charges will be. We will give fixed estimates as to any work that will be carried out but that is not always applicable where matters are ‘open-ended’ and are not capable of fixed estimates. In such cases, we shall give you full details of our charging rates and our costs generally. Please ask though if there is any aspect of our rates that you do not understand – we’re happy to help.
