Assessment of - the ability of the debtor to repay the money that you are owed is crucial and we will work with you to ascertain the true worth of the debtor before committing you to a particular method of recovery.

Court Proceedings

In some cases court proceedings are the only sensible route, particularly where the debt is disputed or there are legal complexities to the case which require court adjudication. If and when judgment is obtained care is then needed when enforcing the judgment. We can advise on the best means of enforcing a judgment whether it be through bailiffs, warrant of execution, charging orders, attachment of earnings or even insolvency.

Insolvency

In some cases – particularly where the debt is straightforward and undisputed – it may be appropriate to issue a ‘Statutory Demand’ which is a legal document demanding payment of the debt. If the sum is not paid (or an acceptable compromise reached) insolvency proceedings can be issued (bankruptcy in the case of an individual or winding up in the case of a company). This method can be particularly effective where debts are straightforward. The costs of the demand can usually be added to the debt. We can advise on all aspects of this procedure.

Costs

If you recover your costs you will usually recover the majority, if not the entirety, of your costs. We appreciate that debt recovery advice has a cost. We will be clear and transparent from the outset as to what our charges will be. We will generally try to give fixed estimates as to any work that will be carried out but where that is not possible we shall give you full details of our charging rates and our costs generally.
