Contract Disputes

James Pearce & Co can advise on all aspects of disputes including interpretation and assessment of your rights and liabilities under a particular contract. We can advise as to whether you are likely to succeed in any court action based on the contract or to successfully defend the court action.

Court Proceedings

We routinely act on behalf of parties in both the County Court and High Court. We will advise you as to whether proceedings are appropriate and in your best interests or, if you have received such proceedings, as to whether if appropriate to defend those proceedings. In appropriate circumstances we can advise upon whether specialist counsel advice is required. We are always mindful as to costs in court matters and will advise you fully as to the prospects of recovery of costs and/or your potential liability for costs.

Mediation

James Pearce & Co civil litigation lawyers are keen to help parties to resolve disputes if at all possible. Such resolution may take the form of alternative dispute resolution (ADR) which can prevent expensive proceedings. We will always consider whether this means of resolution is appropriate and advise accordingly.

Enforcement of Judgments

It is often the case that judgment is obtained by an individual or business but that it is then difficult or even impossible to enforce. We are specialists in advising upon the best way of enforcing judgments whether it be through a warrant of execution, a charging order or even in some cases, the threat of insolvency or bankruptcy. We do our very best to recover your money for you.

Debt Recovery

Costs

We appreciate that Civil Litigation advice has a cost. We will be clear and transparent from the outset as to what our charges will be. We will generally try to give fixed estimates as to any work that will be carried out but where that is not possible we shall give you full details of our charging rates and our costs generally.
