Deeds of Variation

In certain restricted circumstances a will can be varied even after the death of the testator (the person making the will) by means of a deed of variation. This is often done on the grounds that the will leads to unfair or unintended financial (particularly taxation) consequences. If the variation would affect the rights of children (either existing or as yet unborn) court approval will be required.
